Terms and Conditions of the "Enara Wi-Fi" mobile application

1. General

"Enara Wi-Fi App" is the call forwarding application of the Enara Wi-Fi monitor ("the App") of Alcad Electronics S.L. ("Alcad"), a company registered at Polígono Arreche-Ugalde, nº1, Apdo.455, 20305 Irun, Gipuzkoa, Spain (www.alcadelectronics.com).

By installing the Application, you agree to be bound by the following terms and conditions (the "Terms") and our Privacy Policy. Read them carefully before installation or acceptance. If you have any questions about the Application or these Terms, please contact Alcad. If you do not agree to these Terms, you must stop using the Application immediately.

 

2. Definition of keywords

The Enara Wi-Fi monitor's "Call Forwarding Service" enables you to stay connected to your Alcad intercom at all times.

"Alcad" is the company that provides the "Call Forwarding Service" for the user.

"Licence" means the serial number or identification code or QR code containing a series of alphanumeric characters and held by the user, with which it is uniquely associated, and which is used for authentication of the Call Forwarding Service.

"Enara Wi-Fi Monitor" is the video door entry monitor with 2-WIRE technology installed in the user's home/company.

"Enara Wi-Fi App" is a free app available for iOS and Android on Apple Store and Google Play, respectively.

"Material" means all information, video messages, data, text, text, music, sound, photographs and graphics, the selection and arrangement thereof, and all source code, software compilations and other material contained in or available through the Application.

"Privacy Policy" is Alcad's data protection and privacy policy which is available at https://www.alcadelectronics.com/es/aviso-legal

"Trademarks" are the trademarks, service marks and logos included in the Application owned by Alcad.

"User" is the person who intends to use the service and accepts these Conditions.

"User Receiver Unit" means the internal audio/video unit (commonly called a home terminal or monitor).

"Visitor Calling Unit" is the external calling unit (commonly called the outdoor panel).

 

3. Enara Wi-Fi App" application

The "Call Forwarding Service" can only be accessed by scanning the QR code in the settings menu of the home terminal using the respective function in the Application (*). Prior to this, you will need to create an account by registering with the Application with an email address of your own.

The Application enables you to perform the following functions:

Easily link your mobile device to your home terminal by using secure QR code scanning, accessible from the terminal's Settings menu. You will need to create a user account, which is easily done by using your own email address.

Receive calls made to the monitor of the linked dwelling from any outdoor panel or external unit of the installation, with the option to communicate with the visitor by audio and video from a remote location (**).

Monitor all outdoor panels of the same installation/project, with the option to carry out direct video and audio communication with this panel.

Door opening: through monitoring or during the course of a call received by a visitor.

Enable and disable APP push notifications on your smartphone or Tablet.

Select language: Spanish, English or French.

The ability to link up to 4 smartphones/tablets per house/apartment per account for receiving audio and video calls, as well as remote opening of the building/home door during the call (***).

The call forwarding service of the APP requires Wi-Fi connection of the Enara Wi-Fi monitor (MVC-152) to a network with Internet access (not included in the installation), which can be the home/property’s own connection and not necessarily a community one.

(*) Note1: ALCAD does not guarantee the full or partial functionality of the app on all mobile terminals on the market. Application validation tests performed by Alcad with different smartphone and tablet operating systems indicate compatibility with Android 9.00 (August 2018) or higher, and iOS11 (July 2018) or higher.

(**) Note 2: Reception of video and audio signal at mobile terminals may be affected by external factors beyond the control of Alcad (coverage, network traffic, service and network bandwidth, etc.).

(***) Note 3: After linking by QR scan to a second, third, fourth, fifth or sixth mobile terminal ("secondary terminals"), the remote monitoring function shall be deactivated for all users. This functionality can be restored by unpairing the secondary mobile terminals.

 

4. Proprietary rights and user licence

The copyright, database rights and other intellectual property rights in all Material and Trademarks included in or available through the Application are owned by or licensed to Alcad. All rights reserved.

Alcad hereby grants you a worldwide, non-exclusive, royalty-free, revocable license to use the Application for your business and personal use in accordance with these Terms.

You may view, print or download extracts of the Material for your personal use, but you may not copy, edit, change, reproduce, publish, display, distribute, store, transmit, commercially exploit, broadcast or otherwise use the Material in any way without Alcad's express consent.

You may not use, copy, edit, change, reproduce, publish, display, distribute, store, transmit, commercially exploit or disseminate the Trademarks without the prior written consent of Alcad or its group companies.

 

5. Conditions of use

The Application is made available to you free of charge for your personal use and may not be used for any commercial purpose or for any unlawful or unauthorised purpose.

Alcad reserves the right to modify or revoke the Application, or to charge you for the Application or the service provided in accordance with these Terms, at any time and for any reason.

You agree that the terms of the agreement with your respective mobile network provider will continue to apply when you use the Application. Accordingly, you may be charged by your mobile network provider for access to network connection services during connection when accessing the Application or any other third party charges that may arise. You assume responsibility for any such charges that may arise.

 

6. Standards of Conduct

When using the Application you must comply with all local laws in your country of residence, any other applicable international laws and these Terms.

In particular, but not limited to, you shall agree not to:

  1. Use the Application in an unlawful manner or in a manner that encourages illegal activity, including, but not limited to, copyright infringement; or
  2. Attempt to gain unauthorised access to the Application or any networks, servers or computer systems connected to the Application; or
  3. Modify, adapt, translate or reverse engineer any part of the Application, or reformat or frame any part of the pages comprising the Application, except to the extent expressly permitted by these Terms or applicable law; or
  4. Allow third parties on your behalf to: (i) make and distribute copies of the Application; (ii) attempt to copy, reproduce, alter, modify, reverse engineer, disassemble, decompile, transfer, exchange or translate the Application; or (iii) create derivative works of the Application of any kind.

You agree to indemnify Alcad in full on demand for any losses, damages, costs or expenses you suffer or incur directly or indirectly as a result of your use of the Application in any way that is not in accordance with these Terms or applicable law.

 

7. System Requirements

In order to use the Call Forwarding Service, the User must have an Alcad User Receiver Unit in his/her home/business model MVC-152 (Enara Wi-Fi Monitor). In addition, it requires connection to a network with internet access (not included in the installation) in order to connect the receiver unit through its Wi-Fi, which can be a home/company connection, without the need for a community connection.

Audio/video communication may not work on some smartphone or tablet models. Currently, Android versions higher than 9.00 (August 2018) and iOS versions higher than IOS11 (July 2018) are required.

The services offered through the Application provide remote interaction with the User's Receiving Unit via the Internet network (Wi-Fi or 3G-4G-5G mobile data). In these cases, proper performance and integration between the Receiving User Unit and the Application may depend on:

  1. Internet signal quality.
  2. The type of Internet access contract contracted by the owner.
  3. The type of data contract on your smartphone.
  4. The number of simultaneous accesses in the same Enara Wi-Fi monitor installation.

When one of these 4 items does not meet the specifications required in the product's technical operating manual, Alcad will not assume any liability for any failure.

 

8. Availability

This Application is available for mobile devices with Apple iOS and Android OS operating systems. Alcad will make every effort to make the Application available at all times. However, you accept that the Application is delivered over the Internet and mobile networks and that the quality and availability of the Application may be affected by factors beyond Alcad's reasonable control.

Alcad and its group of companies shall not assume any responsibility for the unavailability of the Application, nor for any difficulty or impossibility of downloading or accessing content, or any other failure of the communication system that may result in the unavailability of the Application.

 

9. Advertisers on the Application

We are not responsible for any advertisements contained in the Application. If you agree to purchase goods or services from any third party advertised on the Application, you do so at your own risk. The advertiser, and not Alcad, shall be responsible for such goods or services and if you have any queries or complaints in relation to these, your only recourse shall be against the advertiser.

 

10. Suspension of service

Alcad reserves the right to suspend or cease the provision of any service in connection with the Application, with or without notice, and will not be liable to you if it chooses to do so.

 

11. Limitation of liability

In no event shall Alcad be liable for any direct, indirect, special, punitive, exemplary or consequential damages or losses of any kind whatsoever arising out of your use of or access to the Application, including loss of profits or the like, whether foreseen or unforeseen by the parties, and whether based on breach of contract, tort (including negligence), product liability or otherwise.

Alcad shall not be liable to you for any damage or disruption to your equipment, including but not limited to computer equipment, portable devices or mobile phones as a result of the installation or use of the Application.

 

12. Full agreement

These Terms constitute the entire agreement between you and Alcad in relation to your use of the Application.

Alcad reserves the right to update these Terms periodically. In such a case, the updated version shall take effect immediately. You are responsible for periodically reviewing these Terms in order that you are aware of any changes to these Terms and will be bound by the new policy through your continued use of the Application.

 

13. Severability

If any provision of these Terms is held by a court of competent jurisdiction to be invalid or unenforceable, it shall be construed as nearly as possible to reflect the intentions of the parties as reflected in the provision, and all other provisions shall remain in full force and effect.

 

14. Absence of waiver

The failure of Alcad to exercise or enforce any right or provision of these Terms shall not constitute a waiver of such right or provision unless acknowledged and agreed to by Alcad in writing.

 

15. Applicable legislation and jurisdiction

These Terms and Conditions shall be governed by and construed in accordance with Spanish law and you agree to be subject to the exclusive jurisdiction of the Spanish courts.
